The Enforceability of Judicial Appraisal Proceedings

The conduct of a judicial investigation, like proceedings before any court, is subject to strict adherence to the fundamental principle of adversarial proceedings. Consequently, the question frequently arises—particularly in industrial litigation—as to whether a judicial expert report is enforceable against third parties or insurers who did not participate in the investigation.
